1. Terms and Conditions
This document governs the relationship between the user and Stellux India under the Indian Contract Act, 1872.
A. Business Identity & Disclosures Stellux India is a sole proprietorship owned by Ibrahim Lubaib Valappil, registered at Building No. 3/223 B, VALAPPIL Building, Malappuram Parappanangadi Road, Karumbili, Oorakam Kizhmuri-Post, Malappuram, Kerala – 676519. GSTIN: 32BOPPV0714L1ZM.
B. Limitation of Liability: To the maximum extent permitted by law, Stellux India’s total liability for any claim arising out of the purchase of a product shall not exceed the actual amount paid by the customer for that specific product. We are not liable for any indirect, incidental, or consequential damages (such as loss of electricity, fire, or property damage) arising from the use or improper installation of our lighting fixtures.
C. Installation Disclaimer All lighting fixtures sold by Stellux India must be installed by a certified/qualified electrician. Stellux India is not liable for any damage, short circuit, or injury resulting from DIY installations or improper handling by unauthorized personnel.
D. Governing Law & Jurisdiction These terms are governed by the laws of India. Any legal disputes shall be subject to the exclusive jurisdiction of the courts in Malappuram, Kerala only.
2. Replacement, Refund, and Cancellation Policy
A. Replacement Criteria
- Manufacturing Defects Only: We offer replacements strictly for manufacturing defects reported within 7 days of delivery.
- Non-Returnable Goods: Due to the technical and fragile nature of lighting fixtures, we do not accept returns or provide refunds for “change of mind,” aesthetic dissatisfaction, or size miscalculations by the customer.
- Condition for Replacement: The product must be in its original packaging, with all components, manuals, and the original invoice.
B. Out-of-Stock Resolution If a replacement for a defective item is unavailable:
- A full refund will be initiated to the original payment method.
- The customer may opt for an alternative product. If the new product is priced higher, the customer pays the difference; if lower, the balance is refunded.
C. Refund Timeline Refunds (in out-of-stock cases) are processed within 1–7 business days after the defective product is received and inspected at our warehouse.
D. Cancellation Policy Orders can only be cancelled before they are processed. Once an order status is marked as “Processed” or “Shipped,” no cancellations are allowed. To cancel, email info@stelluxlighting.com immediately.
3. Privacy Policy
A. Data Collection & Purpose We collect your Name, Address, Phone Number, and Email strictly for the purpose of fulfilling your order (Contractual Necessity) and providing customer support.
B. Consent & Withdrawal By placing an order, you provide explicit consent to the processing of your data for delivery. You have the right to withdraw this consent or request the deletion of your data by contacting our Grievance Officer, though this may prevent us from providing further services.
C. Third-Party Sharing Your data is shared only with authorized Logistics Partners (for delivery) and Payment Gateways (for transaction processing). We do not sell your personal data to marketing agencies.
4. Shipping and Delivery Policy
Timeline: 5–10 business days across India.
Force Majeure: Stellux India is not liable for delays caused by “Acts of God,” strikes, lockdowns, or carrier delays beyond our reasonable control.
Inspection: Customers are advised to record an unboxing video. This serves as the primary evidence for any “damage during transit” or “manufacturing defect” claims.
5. Mandatory Grievance Redressal
In accordance with the Consumer Protection (E-commerce) Rules, 2020, the details of the Grievance Officer are:
